FAYETTEVILLE KRAV MAGA - LIABILITY WAIVER
I, the undersigned participant (or parent/legal guardian of a minor participant), want to take part in training, classes, private lessons, seminars, sparring, conditioning, self-defense instruction, and related activities offered by Fayetteville Krav Maga, its owners, instructors, employees, contractors, landlords, and affiliates (together, the “School”).
1. Nature of the activity
I understand that Krav Maga and related martial arts, combatives, fitness, and self-defense training involve strenuous physical contact, striking, grappling, throws, takedowns, weapons-defense drills (including training knives, sticks, and simulated firearms), live partner work, and, if I enroll in those programs, firearms and live-fire training at an outdoor range or other off-site location. These activities are inherently dangerous.
2. Assumption of risk
I understand and voluntarily assume all risks of participation, whether known or unknown, including but not limited to: bruises, sprains, strains, fractures, dislocations, cuts, eye or dental injury, concussion or other head injury, spinal injury, paralysis, heart attack, heat illness, allergic or asthma reactions, transmission of illness, property damage, and death. I understand that other students, instructors, equipment, mats, flooring, weapons training tools, and range conditions can cause injury even when everyone is careful. I accept that no amount of instruction, padding, or supervision can eliminate these risks.
3. Fitness and medical disclosure
I represent that I (or the minor) am physically and mentally able to participate. I will tell the School about any relevant medical condition, injury, medication, or limitation (including asthma, heart issues, pregnancy, prior concussion, joint problems, or seizure history) before training. I understand the School is not a medical provider and does not diagnose or treat injuries. If I feel pain, dizziness, or distress, I will stop and notify an instructor.
4. Rules and safety
I agree to follow all School rules, instructor directions, and range safety rules. I will not train while impaired by alcohol, drugs, or any substance that affects judgment or coordination. I will use only approved training equipment. I understand that unsafe, aggressive, or disrespectful conduct can result in immediate removal without refund.
5. Release of liability
TO THE FULLEST EXTENT ALLOWED BY ARKANSAS LAW, I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the School and its owners, officers, instructors, employees, volunteers, independent contractors, landlords, and agents from any and all claims, demands, and causes of action for injury, death, or property damage arising out of or related to my participation, including claims based on ordinary negligence. This release does not apply to injury caused by the School’s gross negligence or willful or wanton misconduct.
6. Indemnification
I agree to indemnify, defend, and hold harmless the released parties from any claims, damages, costs, and attorney fees arising from my (or the minor’s) participation, my breach of this agreement, or my failure to follow rules, including claims brought by family members or third parties.
7. Medical authorization
If I am injured and cannot consent, I authorize the School to obtain emergency medical care. I accept full financial responsibility for that care. I will not hold the School responsible for first aid or emergency decisions made in good faith.
8. Personal property
I am responsible for my belongings, vehicles, and equipment. The School is not liable for lost, stolen, or damaged property.
9. Minors
If the participant is under 18, I am the parent or legal guardian. I have read this agreement, I consent to the minor’s participation, I accept the risks on the minor’s behalf, and I sign this waiver for myself and for the minor. I understand that some claims belonging to a minor may not be fully waivable under Arkansas law, and I still agree to the indemnification and assumption-of-risk provisions that apply to me as the parent/guardian.
10. Term and governing law
This agreement applies to all present and future participation until I sign a new one or the School requires a renewal. It is governed by the laws of the State of Arkansas. If any part is held unenforceable, the rest remains in effect. This is the entire agreement on these subjects.
11. Acknowledgment
I HAVE READ THIS WAIVER. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I SIGN IT FREELY AND VOLUNTARILY.
